OVERVIEW Welcome to Back Mechanics! The terms "we", "us" and "our" refer to Back Mechanics. Back Mechanics operates this website, including all related information, tools, and services in order to provide you, the customer, with in-home massage therapy and related physical wellness services (the "Services"). Back Mechanics is powered by Shopify, which enables us to provide the online booking and payment Services to you. The below terms describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence. To use the Services, including booking an appointment, you will be asked to provide certain information, such as your email address, billing, payment, and service location information. You represent and warrant that all the information you provide is correct, current and complete.

SECTION 2 - OUR SERVICES We have made every effort to provide an accurate representation of our services. However, massage outcomes vary by individual. We do not warrant that the results of any services purchased by you will meet your specific expectations, though we do stand by our 100% Relief Guarantee as outlined in our Refund Policy. All descriptions of services and service areas are subject to change at any time without notice at our sole discretion.

SECTION 3 - BOOKINGS AND APPOINTMENTS When you book an appointment, you are making an offer to purchase a service block. Back Mechanics reserves the right to accept or decline your appointment for any reason at its discretion (including, but not limited to, being outside of our designated service area). Your order is not accepted until Back Mechanics confirms acceptance. Your purchases are subject to return or cancellation solely in accordance with our stated Cancellation & Refund Policy.

SECTION 4 - PRICES AND BILLING Prices are subject to change without notice. The price charged for a service will be the flat-rate price in effect at the time the order is placed. You agree to provide current, complete and accurate payment information for all bookings. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card, and (iii) you will pay charges incurred by you at the posted flat-rate prices.

SECTION 5 - CLIENT CONDUCT & SERVICE ENVIRONMENT (IMPORTANT) Because our Services are provided in your home or office, we require a safe, clean, and appropriate working environment. You agree to provide an adequate space (approximately 5x9 feet) for equipment setup. Back Mechanics strictly provides therapeutic, clinical-grade bodywork. Any illicit, sexually suggestive, or inappropriate behavior, remarks, or requests will result in the immediate termination of the session. In such an event, you will be charged the full rate for the scheduled service, you will be permanently banned from booking future appointments, and local authorities may be notified. We reserve the right to refuse service to anyone, at any time, if the practitioner feels unsafe or the environment is deemed unsanitary or hazardous.

SECTION 6 - INTELLECTUAL PROPERTY Our Services, including all text, branding, images, and graphics are owned by Back Mechanics and are protected by intellectual property laws. You must not reproduce, distribute, or create derivative works of any of the material on our website without our prior written consent.

SECTION 7 - THIRD-PARTY LINKS & OPTIONAL TOOLS The Services may contain links to third-party websites (such as our booking partner, Appointo). We provide access to such tools "as is". We are not liable for any harm or damages related to your use of third-party tools or websites.

SECTION 8 - RELATIONSHIP WITH SHOPIFY [NOTE TO MERCHANT: This section accurately characterizes Shopify's relationship with your store and should not be removed or modified.] Back Mechanics is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Back Mechanics. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Back Mechanics, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Back Mechanics.

SECTION 9 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, information you submit will be transmitted to and shared with Shopify to process your bookings.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Back Mechanics, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF ANY OF THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
